up for any of our services or you must terminate your existing account immediately.
By using our service for any period of time you have agreed to these terms automatically.
Any user found in violation of these regulations will be subject to account termination with no refund and, if necessary, referral to law enforcement authorities for criminal prosecution. Accessgate.net Inc offers you access to the Internet. You hereby acknowledge that the Internet is not owned, operated, managed by or in any way affiliated with Accessgate.net / Intelligent Software Inc or any of its affiliates, it is a separate network of computers independent of Accessgate.net / Intelligent Software Inc. Your use of the Internet is solely at Your own risk and is subject to all applicable local, state, national and international laws and regulations.
Local dial in access is YOUR sole responsibility to check that you are dialing into a local access number. Access to the Internet is dependent on numerous factors, technologies and systems, many of which are beyond Accessgate.net authority and control. Accessgate.net Inc reserves the right to, from time to time, monitor Your activity. The transmission of any material in violation of any United States or state regulations is prohibited. This includes, but is not limited to, copyrighted material, material legally judged to be threatening or obscene, material protected by trade secret or material that is otherwise deemed to be proprietary or judged by Accessgate.net Inc to be inappropriate or improper such as unsolicited bulk e-mail messages. SENDING OUT VIRUSES IS NOT PREMITTED.
Accessgate.net Inc has zero tolerance for unsolicited bulk e-mail messages and reserves the right to terminate the Connection in the event that Accessgate.net Inc. becomes aware that You, or persons making use of Your services are using the Accessgate.net Inc network for the distribution of unsolicited bulk e-mail messages. Access to other networks connected to Accessgate.net Inc network must comply with the rules appropriate for that other network. Accessgate.net Inc exercises no control whatsoever over the content of the information passing through its network. Accessgate.netInc MAKES NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THOSE OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. THIS INCLUDES LOSS OF DATA RESULTING FROM DELAYS, NONDELIVERIES, MISDELIVERIES OR SERVICE INTERRUPTION HOWEVER CAUSED. USE OF ANY INFORMATION OBTAINED BY Accessgate.net / Inc. NETWORK IS AT YOUR OWN RISK. Accessgate.net Inc. SPECIFICALLY DISCLAIMS ANY RESPONSIBILITY FOR THE ACCURACY OR QUALITY OF INFORMATION OBTAINED THROUGH ITS SERVICES.
Routine maintenance and periodic system repairs, upgrades and reconfigurations may result in temporary impairment or interruption in service. As a result, Accessgate.net e Inc does not guarantee continuous or uninterrupted service and reserves the right from time to time to temporarily reduce or suspend service without notice Sign Up Policies : You must provide accurate, current, and valid information including payment arrangements and credit card numbers and expiration dates when signing up for service. All new accounts payment is at start of service. The set up fee is non refundable. Credit card account will be monthly for $19.95 or more depending upon your service automatically on your credit card. Check payment are due every three months at $19.95per month x 3 or 59.95 or more dending upon your service per month.
We do not refund paid accounts and we require 30 days written notice of termination, prior to termination. Dial up Restrictions: All dial accounts are limited to one user or household and may not be shared with other persons or organizations. A single account may only be logged on one computer at a time. If your account is logged in twice that is cause for termination with no refund. Personal accounts have up to 50 hours per month per account. Once you go over into the next 50 hours you will be charged for the additional account. Business account have up to 200 hours per month, once you go over this time you will be charged for an additional account. Unlimited Access is not available: Personal accounts are only allowed up to 50 hours per month. You may add another account which will add another 50 hrs for that month. We do not offer unlimited access, unless you have a dedicated T1. Business accounts are for busiensses only at 200 hrs per month. All accounts who have abused this system may only be on automated credit card, your credit card will be processed for the additional time used. We reserve the right to terminate any account(s) with no refund. Downloading: Your Modem over a regular internet connection are not designed to download huge files such as software more than ten megs. It is better for your system to buy the CD ROM from the software company. E - Mail:
All Accessgate.net Inc customers may not at any time send "spam" unsolicited bulk e-mail in any quantity. Any threatening or inappropriate e-mail's in joke or for real will be handed over to the FBI along with all log files and account information of any Accessgate.net Inc customer who is abusing or thought to be abusing the Internet. Their account will be placed on hold and or terminated with no refund. Billing Policies: You may make payment via Cash, check, money order or credit card: Visa or Master card . Once we have walked you through the set up process even if you cancel the account for any reason you will not be refunded the first months fee. If you have not paid than you are still responsible to pay the set up for our time. We do not refund. Renewals: Renewals are due within 5 days of invoice due date, invoices are mailed 15 days ahead. If on credit card payment if not otherwise stated at sign up your renewal will be based on credit card procedures. Credit Cards: Unless otherwise specified at time of sign-up when you give your credit card number to us this will be used for you initial invoice and also for renewals automatcially. If a charge back is made you / your account is liable for the charge back fees. Termination of Service: Accessgate.net Inc reserves the right to suspend overdue accounts without prior notification. Accounts will not be reactivated until payment is received. Accessgate.net Inc reserves the right to terminate any account that the head administrator feels is a threat or danger to our system, or any Accessgate.net Inc customer (s) in anyway. There will be no refund.
Non use of account IS NOT A NOTIFICATION OF TERMINATION; you are responsible to notify us in 30 days prior writing to terminate an account. You are still responsible for payment of term Their are no refunds. All termination requests must be submitted prior to the date you are due for renewal or you will be billed for the following months of service under your current contract. Returned checks: Will result in a $25 fee in addition to the cost of service. Freezing / Holding an account: At your request we may temporarily freeze your account for a minimum period of one month for long vacations, financial and other, only if request has been made to the accounting dept. PRIOR to the hold time. User names and passwords: Authorized only for use by the holder (the person to which the account name is under) of an account or other persons specifically authorized to use the account. Any unauthorized entry into your account by releasing your password will result in account termination with no refund and you will be held fully responsible for any possible illegal activity. If you suspect that your account has been entered or hacked illegally, it is your responsibility to notify us immediately. Viruses and or hacking: Accessgate.net Inc. is not responsible for persons, viruses or computers who hack into your system via the Internet or Intranet. We are also not responsible for your computer manufacture or your software developer who unknowing to you transmits your system's information or personal information to or from your computer via our services. This is done without our consent and we have no control over their actions.
We are not liable in any way for virus that are passed through our network - we will secure at our network at any time from viruses which may effect your e-mail in order to stop virues and or hackers. Local Phone Numbers: We now have national dail in access numbers. It is always your responsibility to make sure the local number you are using is local to you. Accessgate.net Inc. has no arrangement with your contract and billing that you have with your phone company.
We are not liable for ANY PHONE BILLS YOU MAY RECEIVE. Abuse: The correct authorities will be notified if any unauthorized duplication, manipulation, or destruction of data, programs or software on any local or remote system is prohibited. This also includes software piracy. Any acts of abuse or slander towards local or remote users or administrators of Accessgate.net / Intelligent Software Inc. are strictly prohibited and may result in account termination with no refund. Should any of these items happen to you, please notify us immediately so we are aware of the problem and may be able to stop or help in any way that we can as soon as we can. Sending any unsolicited e-mail or spamming, bulk e-mail, mail bombing, or forged e-mail from any other account is strictly prohibited. Any user found in violation will have their account will be terminated with no refund. Web pages: Web pages hosted by Accessgate.net / Intelligent Software Inc.. may not contain any offensive, obscene or illegal material. We reserve the right to remove material it we feel it may violate any laws, defame someone's character, or offend anyone at our judgment. Accessgate.net / Intelligent Software Inc is not responsible for any loss of revenue resulting from this policy. The web site will not be posted or re-posted on our equipment. Accessgate.net Inc is not responsible for any harm, losses, or personal injury resulted from the content of web pages or illegal material or links to other sites or areas of the Internet. All personal web pages: are for noncommercial use only. Business web pages: may be used for commercial purposes provided they are legal. Submission of Web pages with subject matter deemed inappropriate including but not limited to pornography, violence, and crack sites (the distribution of software illegally pirated software) is strictly prohibited. Accessgate.net is not responsible for any viruses, hardware damage, and software corruption's. Loss of data or personal injury or loss of revenue resulted from or obtained via the Internet, or by down periods of time. At this time we are not accepting any new Maintenance and acts of God: Their will be times when service is stopped for unknown periods of time due to emergency repair, replacement of equipment or special circuits by Accessgate.net / Intelligent Software Inc or the Phone Company, the Power Company may also have periods of outages that are beyond our control or our back up systems.
Technical support: Tech. support is provided seven (5) days a week by telephone, please leave your name that the account is under and your call back number. Technical support is for customers only if the questions pertain to the Internet. When calling for technical support you must be at your computer with it turned on. We can not give any technical assistance if you are not at your computer. There are no extra charges to your account for technical support. Technical support only for issues related to: Establishing an Internet connection, logging into our servers, configuring your Internet connection, and browser, configuring mail, configuring modem via initialization strings (we may instruct you to call or go to the specific modem vendor web site or to call you computer manufacture for details). Inquiries about any other computer related problems should be directed to the specific vendor or manufacturer. This includes modem problems or fixing the connection speed setting in the modem.
We cannot provide technical assistance for Virus, other than suggesting that you use a virus protection and that the system may / will need to be replace or fixed by a hardware / software vendor.
